Terms of Use — FleetParc

1. Scope and publisher

These terms of use (the “Terms”) set out the rules that apply to the use of the FleetParc mobile app and the FleetParc web console (together, the “Service”), published by Soluflotte. Using the Service constitutes acceptance of these Terms; we recommend reading them carefully before using the Service.

2. Nature of the service

FleetParc is a professional service, intended for businesses and professionals. It is provided under a commercial contract entered into by the customer company; commercial terms (price, duration, renewal, support) are governed by that contract and not by these Terms, which cover only the use of the Service.

3. User accounts

Accounts are created by your company's administrator or by your Service provider, from the FleetParc web console. There is no open registration, either in the mobile app or in the web console. Each account is personal: its permissions are defined by your company's administrator.

4. User obligations

When using the Service, you agree to:

• keep your credentials confidential and not share them with anyone; each account is personal;
• use the Service strictly for professional purposes, within the permissions granted to your account and in compliance with applicable laws;
• keep your device and access to the Service secure;
• not use the Service on a device modified to bypass the system's protections (a “rooted” or “jailbroken” device), i.e. a device on which the software restrictions imposed by the operating system have been removed: such modifications expose the device to malware and may compromise its security features or prevent the app from working properly;
• report any unauthorised access to your account without delay, to your company's administrator or to Soluflotte.

5. Vehicle location data

The positions, trips and statuses displayed are those of the vehicles of the customer company. FleetParc does not collect your phone's location: the mobile app does not use your device's location sensors.

The customer company is responsible for informing its drivers and employees that the vehicles made available to them are fitted with equipment that geolocates them.

6. Intellectual property

Unauthorised copying or modification of the app, of any part of the app or of Soluflotte's trademarks is strictly prohibited. Any attempt to extract the source code, to translate the app or to create derivative versions is also prohibited. The trademarks, copyrights, database rights and other intellectual property rights relating to the Service remain the property of Soluflotte.

7. Service availability

Soluflotte strives to provide a service in line with the state of the art. Its availability depends on the equipment installed in the vehicles, on mobile networks and on access to the internet; interruptions may occur, in particular during maintenance operations. The data displayed (positions, trips, reports) may be shown with a delay. The data displayed is provided for information purposes only. Soluflotte's liability towards the customer company is governed by the commercial contract.

8. Internet connection and charges

Some features of the Service require an active internet connection, either Wi-Fi or a mobile network. Soluflotte cannot be held responsible for degraded operation of the Service where there is no internet access or where your data allowance has been used up.

Outside a Wi-Fi area, your mobile operator's terms still apply: connecting to the Service may incur data charges, including roaming charges if you use it from abroad without disabling data roaming. These charges are borne by the user or by their employer, as agreed between them. If you are not the bill payer for the device used, you are deemed to have obtained the bill payer's permission.

9. Updates

Soluflotte may evolve the app and make updates available to you. You need to accept these updates in order to keep using the app. Soluflotte does not guarantee that the app will remain compatible with the version of the operating system installed on your device.

10. Third-party services

To provide the Service, Soluflotte relies on technical service providers (hosting, security, audience measurement, mapping), solely for the operation of the Service. Some are located outside Morocco: the information sent to them may therefore be processed outside Morocco.

The data sent to each category of provider is described in the privacy policy.

11. Cookies

As part of improving its services, anonymous statistics on the use of the site may be generated, with no audience-measurement cookie and no advertising cookie. The web console only uses a cookie that is strictly necessary to keep you signed in. To learn more, see the privacy policy.

12. Suspension and termination

Soluflotte, your Service provider or the customer company's administrator may suspend or delete a user account, in particular where the commercial contract ends, where these Terms are breached or for security reasons.

If your account is suspended or deleted, your access to the Service ends: you must stop using the app and, where applicable, delete it from your device.

13. Changes to these terms

Soluflotte reserves the right to amend the terms, conditions and notices of these Terms at any time. Any change is published on this page and the effective date above is then updated. Substantial changes are brought to users' attention by any appropriate means before they take effect. We recommend reviewing this page regularly.

14. Governing law and disputes

These Terms are governed by Moroccan law. Unless otherwise stipulated in the contract entered into with the customer company, and failing an amicable settlement, any dispute shall be brought before the competent courts of Casablanca.

16. Privacy

How FleetParc processes your data is described in the privacy policy.

In accordance with Moroccan law No. 09-08, the user acknowledges having been informed that the personal data collected when using the services, in particular their first name, last name and email address as well as vehicle geolocation data, are processed by Soluflotte to provide the Service and, on the web console, to produce anonymous usage statistics. The user has a right of access, rectification and objection, which may be exercised as set out in the privacy policy.
